Terms of Service

These terms form a legally binding agreement between you and CarFolio ("we", "us", "our") covering your use of the CarFolio website and app (the "Service"). By creating an account or using the Service you accept these terms. If you do not accept them, please do not use the Service.

The Service is operated from the United Kingdom and these terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, unless you live elsewhere in the UK, in which case you may also bring proceedings in your local courts.

• You must be at least 13 years old to create an account.
• You are responsible for keeping your login details secure and for all activity on your account.
• You must give accurate registration information and keep your email address up to date.
• You may close your account at any time from your profile or by contacting us, and we will delete your account data as described in our Privacy Policy.

CarFolio lets you photograph or upload images of vehicles you see in public, identifies the make and model, and records them in your personal collection. Identification uses automated image recognition and, where available, publicly accessible vehicle data. It is provided for entertainment only and may be inaccurate or incomplete. Nothing in the Service is a vehicle history check, valuation, insurance record or legal confirmation of ownership.

The Service is free to use. We may change, suspend or withdraw features, and we may set reasonable limits on scans, storage and uploads.

Number plates are automatically masked on every image before it is stored. You must not attempt to defeat, bypass or reverse that masking. You agree that you will:

• only upload photographs you took yourself, or that you otherwise have the right to use;
• only photograph vehicles that are in public places, and never photograph people in a way that is intrusive, harassing or unlawful;
• never use the Service to identify, follow, track, locate or harass a vehicle owner or any other person;
• never take photographs while driving, or in any way that breaks road traffic law or puts anyone at risk;
• never trespass on private property, restricted sites or private car parks to capture an image;
• not upload content that is unlawful, defamatory, obscene, hateful, infringing or otherwise objectionable;
• not scrape, reverse engineer, overload or interfere with the Service, or use it to build a competing dataset.

We may remove content and suspend or terminate accounts that breach these rules or the law.

You keep ownership of the photographs and text you upload. You grant us a worldwide, royalty-free licence to host, store, process, resize, mask and display your content solely so we can operate and improve the Service, including showing your collection, garage and leaderboard entry to other users where you have chosen to make it visible and generating shareable story images at your request. You can revoke this licence by deleting the content or your account.

The CarFolio name, branding, software, catalogue structure, rarity system and design are owned by us or our licensors. Vehicle manufacturer names and models are used descriptively only. Trade marks remain the property of their owners, and CarFolio is not affiliated with, endorsed by or sponsored by any vehicle manufacturer.

Collections, XP, rarity tiers, achievements and leaderboard positions have no monetary value and cannot be sold, traded or transferred. Submitting images that are not genuine real-world spots, manipulating XP, using automation, or creating multiple accounts to gain an advantage may result in the removal of progress or the closure of your account.

The Service is supplied with reasonable care and skill, but we do not promise it will be uninterrupted, error-free or that identifications will be accurate.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under UK law. Your statutory rights as a consumer under the Consumer Rights Act 2015 are not affected.

Subject to that, we are not liable for loss or damage that is not reasonably foreseeable, for loss of profit, business or data, or for loss caused by your misuse of the Service or your breach of these terms. Because the Service is provided free of charge, our total liability to you is limited to GBP 100.

You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these terms, if we are required to do so by law, or if we stop providing the Service. Where reasonable, we will give you notice first.

We may update these terms to reflect changes to the Service or the law. If a change materially affects you, we will let you know in the app or by email. Continuing to use the Service after a change means you accept the updated terms.
